Distance Selling Agreement

The essence of this agreement is to regulate the information regarding the characteristics and sales price of the product specified below, which the buyer has ordered electronically on the ….. website belonging to the seller. It pertains to determining the rights and obligations between the parties in accordance with the provisions of Law No. 4077 on the Protection of Consumers and the Regulation on the Principles and Procedures for the Implementation of Distance Contracts.

The goods/services will be delivered to the person/organization named …… residing at the address …… specified by the buyer.

The buyer declares that they have read and become informed about the main characteristics, sales price, payment method, and preliminary delivery information of the products subject to the contract on the seller's website and have provided the necessary confirmation electronically.

The product subject to the contract, without exceeding the legal period of 30 days, shall be delivered within the period stated on the website depending on the distance of the buyer's residence for each product to the buyer or the designated recipient.It will be delivered to the person/organization at the address provided. If the product subject to the contract is to be delivered to a person/organization other than the buyer, the seller cannot be held responsible for the recipient refusing to accept the delivery. The seller is responsible for delivering the product subject to the contract in good condition, complete, in accordance with the specifications stated in the order, and with any warranty documents and user manuals, if available. Payment of the product price in the buyer's preferred payment method is a condition for the delivery of the product subject to the contract. If the product price is not paid for any reason or is canceled in bank records, the seller is considered released from the obligation to deliver the product. After the delivery of the product, if the buyer's credit card is used unjustly or illegally by unauthorized persons without the buyer's fault, and the relevant bank or financial institution does not pay the product price to the seller, the buyer is obliged to return the product to the seller within 3 days. In this case, the buyer may use one of the rights to cancel the order, replace it with a similar product, or postpone the delivery period until the obstructive situation is resolved. If the buyer cancels the order, the amount paid will be refunded to them in cash and in full within 10 days. Faulty or defective products, whether sold with a warranty certificate or not, can be sent to the seller for necessary repairs within the warranty conditions, in which case the shipping costs will be covered by the seller. Our company is not responsible for typographical errors and incorrect price entries. The buyer has the right to withdraw within 7 days from the delivery of the product under the contract. To exercise the right of withdrawal, notification must be made to the seller via fax, email, or phone within the specified period, and the product must not have been used in accordance with the provisions of Article 6. It must not have been used within the framework. In case of exercising the right of withdrawal, if the product has been delivered to a third party or to the buyer, it is mandatory to return the cargo delivery receipt related to the product sent to the seller and the original invoice. The product price will be refunded to the buyer within 7 days following the receipt of these documents by the seller. If the original invoice is not sent, VAT and other legal obligations cannot be refunded. The shipping cost of the product returned due to the right of withdrawal will be covered by the buyer.
